The Regulatory and Geopolitical Framework

The issue of digital sovereignty is no longer an abstract vision of the future, but an operational reality. With the EU Data Act, the NIS2 Directive, and DORA, Europe has established a regulatory framework that requires organizations to demonstrably ensure control over their data and IT infrastructure.

At the same time, geopolitical developments are increasing the pressure to act. The extraterritorial access provisions of the U.S. CLOUD Act, the repercussions of the Schrems II ruling, and the uncertainty surrounding transatlantic data transfer agreements make it clear: organizations that rely exclusively on non-European infrastructure are taking on a growing compliance and business risk.

Sovereignty as a Design Principle

At ISD FENIQS, we view digital sovereignty not as isolation, but as a design principle. It is not about disconnecting from global technologies. It is about making conscious decisions regarding how and where these technologies are deployed and into which economic sphere the resulting value flows.

We are convinced that European organizations must have the right and the ability to fully control their data, processes, and infrastructure at all times. This means data residency within the EU, transparent supply chains for IT services, control over encryption keys, and a clear understanding of the legal framework governing their own systems. Digital sovereignty is not a monolithic transformation project. It emerges gradually, through consistent decisions at every level of the IT landscape.

As a technology-agnostic partner, we evaluate platforms and providers based on the specific sovereignty guarantees they offer: data residency, control over encryption, auditability, and the avoidance of uncontrolled dependencies. Sovereignty and innovation are not mutually exclusive. They require the right architecture and a partner who evaluates both without any platform bias.
